Age Discrimination Claims Summarily Dismissed in Alameda County |
In the notoriously employee-friendly confines of the Alameda County Superior Court, CDF successfully defeated a complaint of age discrimination brought by a current employee against a Fortune 500 company. Complicated by the fact that the plaintiff remained in the workplace, and that the promotion that the 54-year-old college educated woman sought went instead to a 19-year-old junior college graduate, the attorneys developed evidence to establish that the decision was based on sound business reasons, and achieved dismissal of the claims. The plaintiff continued her employment and continued to present a risk of continued litigation, so CDF successfully negotiated a dismissal by the plaintiff of all claims, known and unknown, in addition to the court’s dismissal of the claims already pursued.
