Primary Practice Area

For almost 20 years, Mr. Forman has helped his clients obtain the efficient resolution of trade secret, complex commercial and a broad range of employment and labor issues and disputes. A wide range of enterprises and individuals place their confidence in Dan's advice and counseling, including non-profit corporations, entertainment companies, service providers, financial institutions, garment manufacturers, retail establishments, high tech companies, hospitals, partnerships, and agricultural enterprises. He frequently drafts employment and arbitration agreements, handbooks, policies, and advises about the enforceability of confidentiality and trade secret agreements, including covenants not to compete, collective bargaining, insurance issues, violence in the workplace, termination of employment and severance, WARN Act, accommodation, discipline, leave, and a wide range of wage and hour issues.

Likewise, when necessary, Dan's clients look to Dan for representation in litigation, trial, arbitration and any related mediation or alternative dispute resolution format as he has significant first-chair trial experience. Dan has experience in state and federal courts in single plaintiff employment matters, class action defense, trade secret, contract, unfair business practice, complex commercial, insurance coverage and real property disputes.

Of import, Dan has a depth of experience representing his clients during investigations and at hearings before California's Labor Commissioner, the Department of Fair Employment and Housing, the Employment Development Department, the Equal Employment Opportunity Commission, and similar agencies on a variety of issues. In addition, he has experience in conjunction with negotiations and appearances before California's Agricultural Labor Relations Board.

Representative Experience and Accomplishments

Mr. Forman's experience includes representation of employers in all aspects of the employer/employee relationship, from before the date of hire until after termination of the relationship, including equal employment opportunity, policy and handbook review, wage/hour issues, discipline, severance, discrimination and harassment claims, collective bargaining agreement negotiations, violence in the workplace, and related matters concerning employers, unions and employees.

In addition, Dan regularly works to prosecute, defend and resolve trade secret disputes, including improper solicitation of employees, materials and clients. He has broad experience defending clients against discrimination, harassment, retaliation, and failure to accommodate claims.

Moreover, Dan's business experience expands beyond employment matters as he regularly counsels on a variety of business and legal needs.

Favorable resolution of malicious prosecution action during third week of jury trial;

Awarded over $1 million and defeated over $15 million of claims in multi-week commercial arbitration;

Created for-profit subsidiary of non-profit corporation;

Conducted investigation into alleged discrimination and harassment that resolved complaint and prevented potential liability;

Resolved $5-$10 million wage and hour class action through mediation.
