CDF represented a prominent hospital in connection with a complaint filed by a terminated employee after the employee failed to return from leave on the employee’s return to work date, failed to contact the employer to seek additional leave and failed to respond to any written communications from the employer. Plaintiff alleged six causes of action, including claims of retaliation for exercising the employee’s right to file a filing a workers' compensation claim and for taking protected leave, as well as claims of discrimination based on an alleged disability. Dawn Irizarry led the defense of this matter and obtained summary judgment of all claims at the trial court level. Irizarry continued to represent her client on appeal, where the California Court of Appeal affirmed the trial court’s ruling on summary judgment. Denisha McKenzie assisted with the summary judgment motion. Denisha McKenzie and Robin Largent also assisted with the appellate briefing.
