On April 30, 2018, the California Supreme Court issued a landmark decision in Dynamex Operations West, Inc. v. California Superior Court. The California Supreme Court has articulated an entirely new standard for determining who is an employee and who is an independent contractor for wage and hour purposes. This ruling makes it significantly more difficult for businesses to classify California workers as independent contractors – thus exposing the business to liability and fines from Labor Commissioner claims, EDD and FTB enforcement actions, and single plaintiff as well as class action lawsuits.
