The #MeToo era has ushered in a “speak up” culture resulting in increased reporting of harassment, discrimination, and retaliation in the workplace.  Today, more than ever, employers must be vigilant in conducting proper and timely internal investigations when they are confronted with evidence or allegations of potential wrongdoing.  A sound workplace investigation can help prevent lawsuits or help keep damages to a minimum.  It can also help identify internal issues and prevent them from resulting in harmful media exposure and criminal penalties.  Yet, employers often get workplace investigations wrong.
