On November 14, the Third District Court of Appeal affirmed summary judgment for our client in a disability discrimination case brought by a former construction worker claiming disability discrimination. In August 2010, the Sacramento Superior Court granted our motion for summary judgment finding that there was no discrimination and no failure to accommodate the employee. The employee appealed. CDF was equally successful on appeal, as Justice Elena Duarte issued the Court's opinion affirming the trial court's ruling and awarding our client its costs on appeal. Mark S. Spring and Connor J. Moyle handled this matter. Moyle argued the case before the three justice panel.
